Clauses for Tenant Applications and Lease Agreements
NOTE: THESE ARE NOT NECESSARY TO ADD BEFORE USING OUR SERVICES, BUT ARE RECOMMENDED ONGOING AS PART OF YOUR APPLICATION AND LEASE PROCESS. FOR ADDED SECURITY, IN ORDER TO REPORT POSITIVE PAYMENTS TO CREDIT BUREAUS, CONSENT MUST BE PROVIDED BY THE TENANT IN THE FRONTLOBBY PLATFORM EVEN IF THESE CLAUSES ARE USED.
In Your Application For Tenancy:
Purpose – it is best practice to give notice and receive consent. If an applicant has a negative rental history, or intends to be delinquent, including the following clauses in your Application will notify and encourage bad actors to not apply. For great Tenants, it is an opportunity to explain that you offer the benefit of helping them to improve their credit rating.
- Information for Screening Applicants. The Applicant consents to the Landlord or their agents collecting, using and disclosing the information in this application to obtain and review credit, financial, employment, background, court, tribunal, tenant history, and other reasonably necessary information about the Applicant (e.g. credit reports, credit scores, background checks, tenant records, and publicly available information), and authorizes the Landlord and past and present landlords, current employers and identified references to share relevant information, for the purposes of assessing this rental application and future lease renewals. The consents provided are effective as of the date of this Application and will be valid for as long as required to fulfill the purposes described herein, subject to applicable law.
- Disclosure to Credit Bureaus. If tenancy is granted, the Applicant consents to the Landlord or their agents reporting tenancy related information, including but not limited to personally identifying information, the amount and timing of rent payments, behaviour, outstanding debts, and the Landlord’s experience, to credit reporting agencies (e.g. Equifax, TransUnion, Landlord Credit Bureau). This information may be included in the tenant’s credit report, credit score, and tenant record and shared with other landlords, credit grantors and other persons having a lawful purpose to obtain it.
In Your Lease Terms:
- Disclosure to Credit Bureaus. The Tenant consents to the Landlord or their agents reporting tenancy related information, including but not limited to personally identifying information, the amount and timing of rent payments, behaviour, outstanding debts, and the Landlord’s experience, to credit reporting agencies (e.g. Equifax, TransUnion, Landlord Credit Bureau). This information may be included in the tenant’s credit report, credit score, and tenant record and shared with other landlords, credit grantors and other persons having a lawful purpose to obtain it. The Tenant also consents to the Landlord or their agents disclosing such information related to their tenancy as is necessary for third-party agencies, including but not limited to financial institutions, lenders, prospective property purchasers, utility providers, government agencies, legal or financial representatives, insurance brokers, underwriters, and telecommunication providers, in compliance with applicable legislation.
